The deposition is one of the most important aspects of your personal injury case. Essentially, it’s an interview with the opposing attorney in which you recount the events that led up to the accident. He/she will ask you a series of questions to secure as much information about the accident and your injuries as possible. The opposing attorney will use this information to build a defense for their client, so what you say matters.

Here are a few tips for giving a good deposition:

  1. Tell the truth—We took your case because the truth was on your side. A deposition is under oath, so don’t embellish the facts. What you say can and will come up again if your case goes to trial, so stick to the truth.
  2. Take your time—There are no extra points for answering quickly. Take time to process every question the attorney asks you, and only answer once you’re ready.
  3. Correct yourself if necessary—If you misspeak, don’t be afraid to tell the opposing attorney you’d like to adjust your answer. It’s better to set the record straight at your deposition than to be forced to do so on the witness stand.
  4. Come prepared—We’ll do everything within our power to prepare you for your deposition, but making sure you’re in the right headspace on the day of your deposition is up to you. Eat a good meal the night before and get plenty of sleep. You want to be fresh and alert for your deposition.
